You see it everywhere: the pop-up asking whether you accept cookies. Most people just click accept. But do you actually know what a cookie does and why you need to have cookies on your website?

What is a cookie?

A cookie is placed on your visitor’s device, which can be used to collect information about the website visit or the user. But you may not just collect this information. That’s why a user must give explicit consent for the cookie. But there’s also a difference between the types of cookies you can use.

Tracking data

With a tracking cookie you can collect data about the internet behaviour of website visitors. Because personal data is processed here, explicit consent must be given for this. By explicit, we mean that a visitor has to tick a box or press a button to give consent. And the visitor must be able to decline the cookie and still be able to visit the website.

Functional data

These cookies support your website. Without the functional cookies, your website can’t work properly. An example is remembering the products a visitor has added to their shopping cart. No consent is needed for these cookies.

Analytical data

With analytical cookies you can find out how the website works. This is therefore purely for yourself as the administrator. That’s why asking for consent isn’t necessary. But it still needs to be stated that these cookies are being placed.

Asking for consent

Before placing cookies that have consequences for the privacy of visitors, consent must first be asked. Without consent, you may not place the cookie. While asking for consent, a number of pieces of information must be clearly provided to the customer:

This information must be accurate and clearly stated. If one thing is wrong, unclear information is provided, the box is pre-ticked, or the visitor can’t access the website if they decline the cookies, the consent doesn’t count.
